TERMS OF SERVICE INFORMATION

Our Services include, for example, the activities of daily living and personal care (e.g., ambulation, bathing, dressing, exercise, feeding, skincare, hair care, nail care, positioning, toileting, transfers, and medication reminding), assistance with household chores (e.g., cooking, meal preparation, light housekeeping, and personal laundry), and assistance with shopping and getting to and from appointments, maintenance of household records, and companionship. Specialized Personal Care services apply to 2-person households requiring personal care or a single person requiring high care. We do not furnish or perform and are not licensed to furnish or perform, medical services, set up medications, or otherwise furnish home health or nursing services.

We will establish a Service Plan with you to outline the specific Services we will provide to you. We will review this Service Plan with you and revise it as necessary, at least annually. We may request your signature to confirm the scope and frequency of service changes.

Rates are determined at Care Consultation. We will charge one-and-a-half times the standard rates for Services provided on New Year’s Eve, New Year’s Day, Easter Sunday, Mother’s Day, Father’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas Eve, and Christmas Day. We will charge an additional $1.00/hr. for weekend service. (Saturday & Sunday). If you cancel our Services less than 24 hours before the time that our in-home service worker (our “Employee”) is scheduled to arrive at your residence, we will charge you for those hours. We will waive those charges in the event of an emergency involving you (e.g., hospitalization) as long as we receive prompt notice of the emergency.

This Agreement continues on a month-to-month basis or until you or we cancel it. You agree to give us at least five (5) days’ notice if you decide to cancel this Agreement. If the safety of our Employees is at risk in furnishing our Services to you, we may cancel this Agreement immediately. Otherwise, we must give you seven (7) days written notice in advance if we decide to cancel this Agreement. We will tell you why we are canceling this Agreement.

You will direct all questions, problems, needs, concerns, or complaints about our Employees or the Services we furnish to you to our Agency Manager, Cindy Cannon, whose office is located at 476 S. Prairie Street, Bethalto, IL 62010; and telephone 618-717-0249 or manager@eirhomecare.com. Our Agency Manager will review the information and respond to you within 5 working days. If you are dissatisfied with our response, you may request a meeting with our Agency Manager to discuss and resolve the matter.

We employ the Employees that we furnish to provide our Services to you. We are responsible for hiring, firing, and disciplining our Employees. We pay the wages, employment taxes, unemployment insurance, worker’s compensation, and Social Security taxes of our Employees. We are responsible for supervising and assigning duties to the Employees. We are liable for damages or liabilities that result in your bodily injury or property damage only if directly caused by (a) our negligent or intentional acts or (b) the negligent acts of our Employees during the course of furnishing Services to you on our behalf.
